The fall session of the Dukes County superior court opened Monday with a grand jury indicting two men, including a Vineyard Haven man on charges of aggravated rape of child.

The grand jury convened Monday. Carlos G. Stevenson, 48, was indicted on one count of aggravated rape of a child with force and five counts of indecent assault and battery on a child younger than 14 years old. According to the indictments, the charges are related to incidents that took place between September 2000 and December 2003 in Tisbury and West Tisbury.

Mr. Stevenson was arraigned in July in district court on the charges. According to documents filed in court, he allegedly threatened to harm the child’s parents if she told anyone what happened.

Matthew P. Tucci, 31, of Boylston, was indicted on two counts of possession to distribute a class A substance (heroin), subsequent offense and two counts of failure to register as a sex offender.

The drug charges are from March and July of this year. In March, Mr. Tucci was arrested after the Martha’s Vineyard Drug Task Force conducted a search warrant at a home in Vineyard Haven, according to a police report. Police allegedly observed and confiscated items associated with drug distribution, including a brown powdery substance consistent with heroin.

In July, Mr. Tucci was arrested in Oak Bluffs by the parking lot on Sea View avenue extension. According to a police report, Mr. Tucci allegedly attempted to swallow something as police approached him, and police later located a backpack containing 11 individually wrapped bags of powder believed to be heroin. In both cases, Mr. Tucci was charged with possession with intent to distribute a class A substance, among other charges.

According to police, Mr. Tucci had also failed to register as a sex offender as required by law. In 2002, Mr. Tucci was convicted in Dukes County superior court of statutory rape.

The superior court sitting runs for most of October with a mix of civil and criminal cases on the docket. The Hon. Richard Chin is presiding over the session.
