The following cases were heard in Edgartown district court.

Sept. 16

Kathleen S. Berard, 56, of Vineyard Haven, was arraigned on Sept. 13 charges in West Tisbury of drunken driving, second offense, negligent operation of a motor vehicle and marked lanes violation. A pretrial hearing was scheduled for Oct. 4.

Sept. 23

Luke J. Thompson, 21, of Cavendish, Vt., was arraigned on Sept. 21 charges in Vineyard Haven of drunken driving, negligent operation of a motor vehicle and a motor vehicle lights violation. A pretrial hearing was scheduled for Oct. 3.

Sept. 26

Anthony M. Cardoza, 23, of Vineyard Haven, was arraigned on Sept. 24 charges in Edgartown of drunken driving, marked lanes violation and resisting arrest. A pretrial hearing was scheduled for Nov. 1.

Rocco D. Carrube, 57, of Lake Mary, Fla., was arraigned on an August 31 charge of domestic assault and battery in Edgartown. A pretrial hearing was scheduled for Oct. 25.

Willa R. Coleman, 19, of West Tisbury, was placed on one year of pretrial probation on August 8 charges in Chilmark of negligent operation of a motor vehicle and a marked lanes violation, ordered not to have any moving violations. According to a police report filed in court, the charge stemmed from a vehicle hitting a utility pole on South Road.

Mathew P. Hubert, 52, of Oak Bluffs, pleaded guilty to a July 17 charge in Oak Bluffs of possessing to distribute a class A drug (heroin), amended from trafficking in heroin/morphine/opium. Sentenced to two and a half years in a house of correction with eight months to serve and the balance suspended for two years, with 72 days of jail credit given. Placed on probation for two years, ordered to pay a $65 monthly probation services fee, remain drug and alcohol-free with screens, have counseling as mandated by probation, to forfeit $390, not to contact known felons, and to submit a DNA sample. The charge stems from police allegedly discovering 19.5 grams of heroin in the home where he was living.

Mathew P. Hubert, 52, of Oak Bluffs, had July 17 charges in Oak Bluffs of possessing a class A drug (heroin) and possessing a class B drug (Ritalin) dismissed upon request of the commonwealth.

Adam L. Smith, 25, of Himrod, N.Y., was placed on one year of pretrial probation on August 24 charges in Oak Bluffs of disorderly conduct and resisting arrest. Ordered to complete 36 hours of community service by March 26 and to write a letter of apology to the Oak Bluffs Police Department by Oct. 15.

Sept. 27

Richard A. Campbell, 37, of Vineyard Haven, pleaded guilty to Sept. 12 charges in Vineyard Haven of domestic assault and battery and disorderly conduct, placed on probation for two years. Ordered to level III probation, to remain drug and alcohol-free, to attend a batterers program and not to contact the alleged victim. Richard A. Richard A. Campbell, 37, of Vineyard Haven, had an August 24 charge in Vineyard Haven of assault and battery dismissed upon request of the commonwealth because the alleged victim was not present.

Harland D. Gibbs, 31, of Georgetown, was arraigned on a July 23 charge in Oak Bluffs of failure to provide a DNA database sample. A pretrial hearing was scheduled for Nov. 1.

Jason M. Lemieux, 30, of Edgartown, was arraigned on an August 8 charge in Edgartown of negligent operation of a motor vehicle, license not in possession and a marked lanes violation. According to a police report filed in court, the charges are allegedly related to a vehicle hitting a utility pole on Edgartown-West Tisbury road. A pretrial hearing was scheduled for Nov. 1.

Michael K. Noonan, 51, of Abington, was arraigned on Sept. 27 charges in Vineyard Haven of possessing a class B drug (Adderal) and possessing a class B drug (Suboxone). A pretrial hearing was scheduled for Nov. 1.

Patrick M. Whalen, 42, of Vineyard Haven, was arraigned on August 24 charges in Vineyard Haven of assault and battery and malicious destruction of property more than $250 (a gold necklace). A pretrial hearing was scheduled for Nov. 1.

Sept. 30

Tihomir Dimitrov, 19, of Oak Bluffs, was placed on one year of pretrial probation on a Sept. 4 charge of assault and battery in Oak Bluffs, ordered to pay $100 in costs.

Kyle J. Dubay, 20, of Vineyard Haven, had a July 17 charge in Vineyard Haven of possessing to distribute a class D drug (marijuana) converted to a civil infraction. He was found responsible and ordered to pay a $25 fine.

Kyle J. Dubay, 20, of Vineyard Haven, had a July 21, 2012 charge in Oak Bluffs of a municipal bylaw or ordinance violation (possessing less than one ounce of marijuana) converted to a civil infraction. He was found responsible and ordered to pay a $25 fine.

Joseph D. Lyons, 49, of West Greenwich, R.I., was arraigned on Sept. 28 charges in Edgartown of disorderly conduct and assault and battery. A pretrial hearing was scheduled for Nov. 4.
