The following cases were heard in Edgartown district court.

Oct. 26

Donald B. Edgar, 60, of Oak Bluffs, was arraigned on an Oct. 21 Oak Bluffs charge of assault and battery with a dangerous weapon (a wrench). A pretrial hearing was set for Dec. 7.

Paul Sylvia Jr., 44, of Vineyard Haven, had a Sept. 17 Tisbury charge of being a fugitive from justice on a court warrant dismissed upon request of the commonwealth.

Nov. 2

Jose Florencio, 35, of Edgartown, was arraigned on an Oct. 31 Edgartown charge of assault. Bail was set at $5,000 and he was ordered not to contact the victim. A pre-trial hearing was set for Nov. 9. The charges stem from allegations that he threatened to harm his ex-girlfriend if she did not have sex with him.

Daniel S. Defoe, 26, of West Tisbury, was arraigned on Oct. 31 charges in West Tisbury of drunken driving, second offense and leaving the scene of property damage. A pre-trial hearing was set for Nov. 23.

Salvador M. Garcia, 39, of Kamas, Utah, admitted to sufficient facts on an Oct. 29 Edgartown charge of drunken driving, continued without a finding until Oct. 30, 2013. He was ordered to pay

$365 in fees, complete a 24-day alcohol driver education program and to lose license for 45 days. He was also found not responsible for a marked lanes violation and a charge of possessing an open container of alcohol in a motor vehicle. A charge of negligent operation of a motor vehicle was dismissed upon request of the commonwealth.

Michael C. Gunn, 25, of West Tisbury, was arraigned on Oct. 28 charges of drunken driving, negligent operation of a motor vehicle and marked lanes violation. A pre-trial hearing was set for Nov. 26.

Gabrielle H. Joubert, 24, of Edgartown, was arraigned on Oct. 26 charges in Edgartown of possession with intent to distribute a Class B drug (oxycodone/Percocet) and possession of a Class B drug (Subutex). A pre-trial hearing was set for Dec. 7.

Richard Lupo, 28, of Oak Bluffs, was arraigned on an Oct. 31 Oak Bluffs charge of assault and battery. A pre-trial hearing was set for Dec. 7.

Cindy Maciel, 56, of Edgartown, was arraigned on an Aug. 22 charge in Tisbury of largency under $250. A pre-trial hearing was set for Dec. 7. The charge stems from allegedly stealing a purse belonging to someone else while riding a VTA bus. Henry E. Miller, 47, of Edgartown will not be prosecuted by the state for July 13 charges in Edgartown of open and gross lewdness.

Jeffrey A. Nash, 24, of Watertown had an Oct. 20 charge in Edgartown of drunken driving dismissed upon request of the commonwealth. He admitted to sufficient facts for a charge of negligent operation of a motor vehicle, continued without a finding for one year, must complete 32 hours of community service and pay $350 in fees.

Christopher M. Tracey, 23, of Vineyard Haven, was arraigned on Oct. 2 charges in Oak Buffs of negligent operation of a motor vehicle and speeding in violation of a special regulation.

Dennis A. Vogel Jr., 23, of Edgartown, will have a June 22 Oak Bluffs charge of disorderly conduct dismissed upon completion of 20 hours of community service by Dec. 5. In a separate case, he will have August 13 charges in Oak Bluffs of municipal bylaw or ordinance violation and littering dismissed upon payment of $200 court costs by Jan. 30, 2013.

Jason Richard Willoughby, 27, of Oak Bluffs, was arraigned on an Oct. 31 charge in Oak Bluffs of possession with intent to distribute a Class D drug (marijuana plants). Bail was set at $500 cash and a pre-trial hearing, originally scheduled for Nov. 5, was continued to Nov. 30. North M. Whitney, 30, of Tisbury, was arraigned on Oct. 22 charges in Edgartown of drunken driving, negligent operation of a motor vehicle, speeding in violation of a special regulation and possessing an open container of alcohol in a motor vehicle. A pre-trial hearing was set for Dec. 14.

Nov. 5

Michael F. Ayers, 49, of Vineyard Haven, was found guilty of a June 1 Oak Bluffs charge of drunken driving, second offense. He was ordered to serve one year in the house of correction, balance suspended two years, ordered to complete a second offenders program, remain alcohol free with random screens and pay $50 in fees. He pleaded guilty to a charge of negligent operation of a motor vehicle and was placed on probation for one year. In a separate case, he admitted to sufficient facts on a June 20 Edgartown charge of negligent operation of a motor vehicle, continued without a finding until Feb. 2013. He was ordered to pay $250 in fees. He also admitted to sufficient facts for a charge of leaving the scene of property damage, continued without a finding until Feb. 2013.

John D. Black, 32, of Edgartown, had a Dec. 8, 2011 charge in Oak Bluffs of conspiracy to violate drug law dismissed upon request of the commonwealth.

Maxo Cadet, 44, of Vineyard Haven, had an August 7 Tisbury charge of assault and battery dismissed without prejudice due to a witness’s failure to cooperate.

Elias A. Ingraham, 32, of Vineyard Haven, was arraigned on Nov. 5 charges in Tisbury of resisting arrest, malicious destruction of property over $250, disorderly conduct, assault and battery, and assault and battery with a dangerous weapon (automobile glass). Bail was set at $500, with $500 surety. A pre-trial hearing was set for Nov. 9. The charges steam from allegedly punching a person and a car window during a fight.

Robert C. Manning, 29, of Vineyard Haven, was arraigned on a Nov. 5 Tisbury charge of assault and battery. A pre-trial hearing was set fro Dec. 6.

Philippe J. Morin, 50, of Vineyard Haven, had a June 7 Oak Bluffs charge of assault and battery dismissed upon request of the commonwealth.
