The following cases were heard in Edgartown district court.

Dec. 1

Nicole S. Cleary, 29, of Edgartown pleaded guilty to a Sept. 25 breaking and entering charge in Edgartown. Ordered to pay $132.57 in restitution, a $50 victim witness fee, and to serve 30 days, with 30 days deemed served. Pleaded guilty to three other Sept. 25 charges of larceny under $250, forgery of check, and uttering false check, placed on probation for one year.

Dec. 8

Jamie Lynn Murphy, 25, of Edgartown, admitted to sufficient facts in a Sept. 11 assault and battery charge in Edgartown, continued without a finding for six months. Ordered to pay a $50 victim witness assessment.

Luke DePriest, 32, of Oak Bluffs, arraigned for charges of possessing to distribute class B drugs, possessing class B drugs, subsequent offense, and conspiracy to violate drug law in Oak Bluffs. Bail set at $800, a pretrial hearing has been continued to Jan. 19, 2012.

Holly A. Hernandez, 38, of West Hyannisport, admitted to sufficient facts on Sept. 22 charges of larceny from a building, larceny by check and forgery of a check, continued without a finding for six months. Ordered to pay $650 in restitution.

David E. Morris, Jr., 52, of Oak Bluffs arraigned on Oct. 31 charges of trespassing and vandalizing a boundary marker in Oak Bluffs over a property boundary dispute with his neighbor. Pretrial hearing set for Jan. 13, 2012.

Peter R. Mercier, 54, of Edgartown had a Sept. 25 assault charge dismissed upon request of the victim.

Ryan S. Amaral, 22, of Edgartown, admitted to sufficient facts on a November charge of conspiracy to violate drug law in Edgartown, continued without a finding for six months. Ordered to remain illicit drug free with screening.

Ian G. Brew, 19, of Oak Bluffs arraigned on an Oct. 8 charge of malicious destruction of property more than $250 in Vineyard Haven, and separate Dec. 8 charges of assault and battery and malicious destruction of property more than $250 in Oak Bluffs. Pretrial hearings set for Jan. 19, 2012.

Patrice A. Carter, 50, of Edgartown pleaded guilty to an Oct. 31 charge of shoplifting by concealing merchandise. Ordered to complete eight hours of community service within 30 days and serve 30 days of probation with a $50 monthly probation fee.

Joaquim B. Freitas, 57, of Oak Bluffs, pleaded guilty to a Nov. 12 charge of larceny over $250 in Oak Bluffs. Ordered to pay $715 in fees.

John D. Black, 31, of Edgartown arraigned for conspiracy to violate drug law in Oak Bluffs. Pretrial hearing set for Dec. 30.

Dec. 9

Drew Moreis, 18, of Vineyard Haven, arraigned on a Nov. 3 charge of assault in Edgartown. Pretrial hearing scheduled for Jan. 13, 2012.

Daniel A. Ben David, 49, of Oak Bluffs, pleaded guilty to a June 28 charge of drunken driving in Oak Bluffs. Restitution is to be determined, and 30 days were deemed served. Also pleaded guilty to a June 28 charge of negligent operation of a motor vehicle, and found not responsible for June 28 charges of a marked lanes violation, speeding in violation of special regulation, and a passing violation. Restitution hearing scheduled for Jan. 13, 2012.

Rebecca B. Rubel, 21, of Westport, Conn., admitted to sufficient facts on a Nov. 23 charge of drunken driving in Oak Bluffs, continued without a finding for one year. Ordered to pay $350 in fees and a $65 monthly probation fee, to forfeit license for 45 days and complete a driver alcohol education program.

Daniel C. Serusa, 41, of West Tisbury, admitted to sufficient facts for an April 15 charge of drunken driving in West Tisbury. Placed on probation for one year, ordered to pay $600 in fees and a $65 monthly probation charge, complete a driver alcohol education program, and to lose license for 45 days. Found not responsible for two other April 15 charges for marked lanes violation and license not in possession.

Dec. 12

Heather W. Merrill, 51, of Manchester, N.H., arraigned on charges of negligent operation of a motor vehicle and drunken driving on Dec. 10 in Edgartown. Jan. 19 pretrial hearing scheduled.

Hanna K. Persson, 17, of Edgartown, arraigned on a Dec. 11 charge of assault and battery in Edgartown. Pretrial hearing scheduled for Jan. 6, 2012.

Dec. 13

Bruce C. Lambert, 57, of Vineyard Haven, had a May 23 charge of drunken driving in Oak Bluffs dismissed upon request of the commonwealth. He admitted to sufficient facts in a May 23 charge of negligent operation of a motor vehicle, continued without a finding for six moths. Ordered to pay $50 for a victim witness assessment and a $50 monthly probation fee. Found not responsible for a third charge of speeding in violation of special regulations.

James A. Willis, 29, of Oak Bluffs, pleaded guilty to a Sept. 22 charge of assault and battery in Oak Bluffs. Ordered to serve 90 days, with credit for 84 days served, ordered to pay $50 victim/witness assessment.
