The following cases were heard in Edgartown district court.

Nov. 25

Jason M. Canha, 39, of Vineyard Haven, arraigned on Nov. 24 charges in West Tisbury of assault and battery and intimidating a witness. Bail set at $500, ordered to refrain from any abuse of the alleged victim, a female. Dec. 13 pretrial hearing set.

Dec. 1

Samuel Kistler, 21, of West Boylston, arraigned on Oct. 20 charges in Oak Bluffs of breaking and entering for misdemeanor and trespass. Jan. 5 pretrial hearing scheduled.

William J. Bernard, 41, of Edgartown, arraigned on Oct. 20 charges in Oak Bluffs of breaking and entering for misdemeanor and trespass. Jan. 5 pretrial hearing scheduled.

Michael Sultan, 45, of Edgartown, admitted to sufficient facts on a May 28 charge in Oak Bluffs of drunken driving, continued without a finding for a year. Ordered to forfeit his license for 45 days, enter an alcohol education program and pay a monthly $65 probation fee plus another $350 in fees and assessments. If he performs eight hours of community service by May 30 and pays $100 court costs, an additional charge of unlicensed operation of a motor vehicle will be dismissed.

Daryl E. Durden, 28, of New Bedford, admitted to sufficient facts on amended charge of possession with intent to distribute a class B drug (oxycodone), June 18 Oak Bluffs case continued without a finding for three years. Ordered to pay $65 monthly probation fee for the first 18 months of his probation and a $50 monthly fee for the remaining 18 months, plus a $50 victim witness fee.

April L. Cerrato, 24, of Oak Bluffs, arraigned on Nov. 30 charge in Oak Bluffs of shoplifting by concealing merchandise. Feb. 3 pretrial hearing scheduled.

Jaime L. Forend, 20, of Oak Bluffs, had a Nov. 3 charge in Vineyard Haven of assault and battery dismissed at the request of the commonwealth and consent of the alleged victim.

Roger Craver, 70, of Chilmark, admitted to sufficient facts on a Nov. 3 charge of drunken driving in Chilmark, continued without a finding for one year. Ordered to pay $350 in fees and $65 monthly probation fee, undergo substance abuse evaluation and treatment, complete a driver alcohol education program, and forfeit his license for 45 days. A second Nov. 3 charge of negligent operation of a motor vehicle was dismissed.

Deirdre Lynch, 37, of West Tisbury, arraigned on Nov. 30 charges in Edgartown of drunken driving, negligent operation of a motor vehicle and marked lanes violation. Pretrial hearing scheduled for Jan. 5.

Ann Tuerff, 51, of West Tisbury, pleaded guilty to a Nov. 9 charge in West Tisbury of drunken driving, third offense, ordered to serve 150 days of a 30-month sentence in the house of correction, with the balance suspended for three years. She was given credit for 22 days already served. Ordered to pay a $65 monthly probation services fee beginning in May, a $500 fine, a $50 victim witness fee and restitution to be determined. Also pleaded guilty to charges of operating a motor vehicle with license suspended for drunken driving, sentenced to 60 days in house of correction, with credit for 22 days served. Also pleaded guilty to charges of uninsured motor vehicle and received one years’ probation and to negligent operation of a motor vehicle and received three year’s probation. Found responsible for possession of an open container of alcohol in a motor vehicle and fined $500. Found not responsible on speeding and marked lanes violations. Charges of operating a motor vehicle with a suspended registration and drunken driving while license suspended for drunken driving were dismissed.

Dec. 2

Karen G. Thomas, 61, of Oak Bluffs, admitted to sufficient facts on an Oct. 26 drunk driving charge, continued for one year. Ordered to forfeit her license for 45 days, enter an alcohol education program, pay a monthly $65 probation services fee and another $600 in fees and assessments. In a Nov. 2 Oak Bluffs case, was ordered to perform eight hours community service on a charge of operating a motor vehicle with a suspended license, at which time the charge will be dismissed.

Ross E. Willey, 23, ofVineyard Haven, had June 17 Edgartown charges of disorderly conduct and resisting arrest dismissed at the request of the commonwealth and consent of the defendant.

Brian C. Martin, 33, of Oak Bluffs, had a July 11 charge of indecent exposure dismissed at the request of the commonwealth.

Dec. 5

Schuyler L Redd, 26, of Boston, admitted to sufficient facts on charges of breaking and entering night-time for felony; larceny from building; and larceny over $250, continued without a finding for two years. Ordered to pay $995 restitution, a monthly $65 probation services fee and a $90 victim witness assessment. Also ordered to stay drug and alcohol free, submit to drug and alcohol screens, and complete a 24-hour supervised residential program in Boston he is enrolled in. Accused of taking computer and other electronic equipment plus personal items from an Oak Bluffs home last June.

Brian C. Martin, 33, Oak Bluffs, placed on pretrial probation for a year on an August 2 assault and battery charge in West Tisbury. Ordered to submit to alcohol testing for six months.

Una M. Donnelly, 44, of Edgartown, placed on pretrial probation for one year on an August 22 charge of assault and battery in Edgartown. Ordered to attend AA meetings at least twice weekly.

Marie Lemieux, 43, of Edgartown, pleaded guilty to an August 10 false prescription charge. Placed on probation for a year and ordered to pay a $90 victim/witness assessment fee and $65 monthly probation fee. Also ordered to undergo drug treatment as mandated by probation.

Jason Lemieux, 28, of Edgartown, admitted to sufficient facts on a June 4 charge for conspiracy to violate drug law in Edgartown, continued without a finding until next June. Ordered to pay a $90 victim/witness assessment and a $50 monthly probation services fee.
