The West Tisbury board of health will see revised plans to bring a recently acquired home on Pond Road into compliance with a state regulation that limits the number of bedrooms in a home based on lot size.
Building inspector Ernest P. Mendenhall issued a cease and desist order on March 2 to Mitch Pennington of True North Construction company for working without a permit on the home, owned by George Szakacs. Mr. Pennington immediately filed for the permits triggering a site visit by Mr. Mendenhall, who discovered the home had seven bedrooms, one more than allowed for its lot size.
The lot is 65,000 square feet. State law requires 10,000 square feet per bedroom for lots which have both a well and a private septic system and are located in nitrogen sensitive areas.
A second letter sent May 7 by the building inspector referred Mr. Pennington to board of health agent John Powers.
“This appears to be an inherited problem from the prior owner,” Mr. Mendenhall told town selectmen last week. Mr. Szakacs bought the home from Elaine K. Schwartz on Jan. 10, 2008, according to town assessor records.
“They chose to submit revised plans to open up a room to reduce the number of potential bedrooms,” Mr. Powers said this week. “They had several options, including putting an enhanced treatment system in the septic and leaching field which would have given them credit for a larger lot size and the additional bedroom.
